These Terms of Service ("Terms") are a binding agreement between you (and any organization you represent) and Kubexer ("Kubexer", "we", "us", "our") governing your access to and use of the Kubexer website, account services, and desktop applications (the "Service" or the "Software"). By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.
Kubexer is a Kubernetes management tool. The desktop application connects to Kubernetes clusters that you control, using credentials (kubeconfigs) that you supply, and performs the operations you direct. Kubexer does not operate your clusters; you do, through the Software. You are responsible for the clusters you connect and the actions you take.
Subject to these Terms and your subscription, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your internal use. All rights not expressly granted are reserved by Kubexer.
The Software, the website, and all related content are owned by Kubexer and protected by copyright and other intellectual-property laws. You may NOT, and may not permit anyone else to: copy, modify, distribute, sell, rent, lease, sublicense, or otherwise make the Software available to third parties; reverse engineer, decompile, or disassemble the Software except to the limited extent applicable law expressly permits notwithstanding this restriction; remove or alter any proprietary notices; circumvent, disable, or tamper with any licensing, authentication, or usage limitation; or use, share, distribute, or resell license keys or paid features without authorization.
Unauthorized copying, distribution, cracking, or other piracy of the Software is a violation of these Terms and of copyright and other laws. Kubexer will enforce its rights to the fullest extent available and may pursue all available legal and equitable remedies — including injunctive relief, statutory and actual damages, an accounting and disgorgement of profits, and recovery of its costs and legal fees — against any person or entity that pirates, cracks, redistributes, circumvents licensing of, or otherwise infringes the Software. You agree to promptly notify us of any unauthorized use you become aware of.
You agree to use the Service only lawfully and only against systems and clusters you are authorized to access. You will NOT use the Service to: access, scan, alter, or interfere with any system, cluster, network, account, or data without authorization; violate any law or any third-party right; introduce malware or attempt to attack, disrupt, overload, or gain unauthorized access to any infrastructure; or otherwise misuse the Service. You are solely responsible for ensuring you are authorized for every cluster you connect and every action you perform.
The Software can perform powerful and potentially irreversible operations on your infrastructure (for example viewing, editing, deleting, draining, restarting, scaling, executing commands inside, and port-forwarding to workloads, and running Helm and other actions). You acknowledge and agree that: you alone direct these operations; you are responsible for understanding their effects before performing them; you are responsible for maintaining backups and for any data loss, downtime, outage, cost, or other consequence that results; and Kubexer is merely the tool through which you act. You use the Software at your own risk.
You are responsible for keeping your account credentials, kubeconfigs, and devices secure; for configuring your clusters' access controls (such as RBAC) appropriately; and for all activity that occurs under your account or with your credentials. The Software acts with the level of access your supplied credentials grant. Kubexer is not responsible for the security of your clusters, for your misconfigurations, or for any loss arising from compromised, over-privileged, lost, or misused credentials.
Paid plans are billed through Stripe on a recurring basis until cancelled, and you authorize those recurring charges. You may cancel to stop future renewals; paid access continues until the end of the current billing period. Except where required by applicable law, fees are non-refundable. We may change pricing on a going-forward basis.
The Service relies on or links to third parties (including your Kubernetes clusters and their providers, Stripe, GitHub, and Google). We are not responsible for third-party services, and your use of them is governed by their own terms.
THE SERVICE AND SOFTWARE ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM DATA LOSS, OR THAT IT WILL MEET YOUR REQUIREMENTS. YOU ASSUME ALL RISK ARISING FROM YOUR USE OF THE SOFTWARE AGAINST YOUR CLUSTERS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUBEXER AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS, OR FOR ANY CLUSTER DOWNTIME OR DATA LOSS, ARISING FROM OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN OF THESE LIMITATIONS, SO SOME MAY NOT APPLY TO YOU.
You will defend, indemnify, and hold harmless Kubexer and its owners, employees, contractors, and suppliers from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from or relating to: your use or misuse of the Service; your operations against any cluster or system; your violation of these Terms or any law; or your infringement of any third-party right.
We may suspend or terminate your access at any time, including for breach of these Terms (in particular piracy, security abuse, or unlawful use). On termination your license ends and you must stop using and delete the Software. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.
We may update these Terms; material changes will be posted here with a new "Last updated" date. Continued use of the Service means you accept the updated Terms.
These Terms are governed by the laws of [Insert governing jurisdiction — e.g., the Emirate of Dubai, United Arab Emirates], without regard to its conflict-of-laws rules, and you submit to the exclusive jurisdiction of its courts, except that Kubexer may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property.
If any provision of these Terms is held unenforceable, the remaining provisions remain in full effect; our failure to enforce a provision is not a waiver; you may not assign these Terms without our prior written consent, and we may assign them freely; and these Terms, together with the Privacy Policy, are the entire agreement between you and Kubexer regarding the Service.
